Jungal Platform Terms of Service

1. Acceptance of Terms

Welcome to Jungal Pty Ltd (“Jungal”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of the Jungal platform, website, and related services (“Services”), whether in Australia or internationally. These are to be read as a broad agreement that covers the website and the platform, along with platform specific requirements for participation. 


By creating an account, browsing, or using the Services, you agree to these Terms. If you do not agree, you must not use our Services.


2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement in your country of residence to use our Services.
We reserve the right to refuse registration or terminate accounts at our discretion.


3. Platform Participation


3.1 For Buyers (Clients)

  • You are responsible for assessing the suitability, skills, and experience of freelancers before engaging them.

  • Jungal does not guarantee the quality, timeliness, or legality of work delivered by freelancers.

  • You agree to communicate clearly, provide required materials, and pay agreed fees promptly.


3.2 For Sellers (Freelancers/Service Providers)

  • You must provide accurate, truthful information about your skills, experience, and availability.

  • You are not an employee of Jungal; you are an independent contractor.

  • You are solely responsible for your work, compliance with laws, and payment of taxes in your jurisdiction.


4. Ratings, Reviews & Feedback

  • Jungal operates a two-way review and rating system.

  • You consent to receiving ratings and reviews, and agree your own reviews will be fair, accurate, and based on genuine experiences.

  • We may moderate, remove, or refuse to publish reviews that breach our guidelines.


5. Accounts & Security

  • You must keep your account credentials secure and notify us immediately of unauthorised use.

  • You are responsible for all activity under your account.

  • We apply high security measures to protect your data, but you acknowledge that no platform is completely risk-free.


6. Subscriptions, Payments & Fees

  • Pricing is stated in Australian dollars unless otherwise specified.

  • Subscription fees are charged in advance and are non-refundable unless required by law.

  • International users are responsible for currency conversion and applicable taxes.

  • Payment processing is handled by trusted third-party providers.


7. Prohibited Conduct

You must not:

  • Use the platform for unlawful purposes.

  • Post false, misleading, or defamatory content.

  • Circumvent the platform by taking work off-platform to avoid fees.

  • Infringe the intellectual property rights of others.


8. Intellectual Property

  • Jungal owns all rights to the platform’s content, design, and branding.

  • Users retain ownership of their original content but grant Jungal a non-exclusive licence to use, display, and promote that content on the platform.


9. Privacy & Data Protection

  • Our Privacy Policy explains how we collect, use, and protect your personal information.

  • By using our Services, you consent to our data practices.

  • You must comply with applicable privacy and data protection laws in your jurisdiction.


10. International Users

  • These Terms apply globally.

  • You are responsible for compliance with local laws in your country.

  • The governing law is that of South Australia, Australia, and disputes will be subject to the exclusive jurisdiction of Australian courts.


11. Limitation of Liability

  • Jungal is not liable for any indirect, incidental, or consequential loss arising from your use of the Services.

  • Our total liability is limited to the amount you paid to us in the 12 months preceding a claim, unless prohibited by law.


12. Termination

  • We may suspend or terminate your account at any time for breach of these Terms.

  • You may close your account at any time, but fees already paid will not be refunded except where required by law.


13. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via the platform or by email. Continued use of the Services after changes take effect constitutes acceptance.
